Terms of Service
These terms are the agreement between you and Lectric Avenue Electronics Ltd. (“we”, “us”) for your use of farmXtra, the farm-management web application at farmxtra.com and its related services. By creating an account or using farmXtra you agree to them. If you are using farmXtra on behalf of a farm or business, you confirm you have authority to bind it to these terms.
1. Your account
You need an account to use farmXtra. You are responsible for keeping your login details secure and for everything done under your account, including by staff members you invite. Tell us promptly at support@farmxtra.com if you think your account has been compromised. You must be at least 18, or the age of majority where you live, to open an account.
2. Plans, payment and cancellation
farmXtra has a free plan and paid plans. Paid plans are billed in advance by subscription through Stripe, at the price shown when you upgrade, in Canadian dollars unless stated otherwise. Applicable taxes are added where required. You can cancel at any time; your paid features continue until the end of the period you have paid for, and we do not give refunds for partial periods except where the law requires it. We may change prices with at least 30 days’ notice; the new price applies from your next renewal.
3. Your data
The information you put into farmXtra — farm records, maps, spray logs, inventory, customer and staff records and so on — is yours. You give us a licence to store, process and display it only as needed to provide the service to you and the people you invite. How we handle personal information is described in our Privacy Policy, which forms part of these terms. You are responsible for having the right to enter any data about other people (for example staff or customers) and for complying with the laws that apply to that data.
You can export your data from the app’s reporting features, and you can ask us to delete your account and data at any time.
4. Acceptable use
You agree not to use farmXtra to break the law, to infringe anyone’s rights, to send spam or unsolicited messages (including through the SMS and email features), to attempt to gain access to other users’ data or to our systems, to reverse-engineer or copy the service, or to overload or interfere with it. We may suspend or close accounts that breach these rules.
5. Agronomic information is guidance, not advice
farmXtra includes pest and disease models, degree-day calculations, spray guides, weather forecasts and similar decision-support tools. These are compiled from published sources and public data and are provided to help you plan, not to replace your own judgement, product labels, or advice from a qualified agronomist or regulator. Weather and sensor data come from third parties and may be wrong or delayed. You are solely responsible for every spray, treatment, harvest and sales decision you make, and for complying with product labels, pre-harvest intervals, re-entry intervals and all applicable regulations. We are not liable for crop loss, residue violations, or other losses arising from reliance on the information in the app.
6. Third-party services
farmXtra connects to services run by others — for example Google (sign-in), Stripe (payments), weather providers, Mapbox and sensor-cloud providers such as Ecowitt. Your use of those services is subject to their own terms. Where you supply your own API tokens or credentials for such a service, you are responsible for that account and its costs.
7. Availability and changes
farmXtra is under active development. We aim to keep it available at all times but do not guarantee uninterrupted service, and we may change, add or remove features, or suspend the service for maintenance. We will try to give notice of significant changes inside the app or by email.
8. Our intellectual property
farmXtra, its software, design, and the farmXtra™ name and logo belong to Lectric Avenue Electronics Ltd. These terms do not give you any right to them beyond using the service as intended.
9. Warranty disclaimer
farmXtra is provided “as is” and “as available”. To the fullest extent permitted by law we disclaim all warranties, express or implied, including fitness for a particular purpose, and we do not warrant that the service or the information in it will be accurate, complete or error-free.
10. Limitation of liability
To the fullest extent permitted by law, Lectric Avenue Electronics Ltd. is not liable for any indirect, incidental, consequential or special damages, or for lost profits, lost crops, lost data or business interruption, arising from your use of farmXtra. Our total liability to you for any claim relating to the service is limited to the amount you paid us for farmXtra in the 12 months before the claim arose. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Ending the agreement
You may close your account at any time. We may suspend or close your account if you breach these terms, if required by law, or if we discontinue the service, in which case we will give you reasonable notice and an opportunity to export your data where practicable.
12. Governing law
These terms are governed by the laws of British Columbia and the federal laws of Canada that apply there. Any dispute will be brought in the courts of British Columbia, unless applicable consumer law gives you the right to bring it elsewhere.
13. Changes to these terms
We may update these terms from time to time. We will post the new version here with a new effective date and, for material changes, tell you inside the app or by email. Continuing to use farmXtra after the change takes effect means you accept the updated terms.
